He's a senior staff in his division, months ago his boss has appointed another person to supervise the division. Last week, again and again he provoked all the staffs not to listen nor report to the supervisor and the climax is he instructed the staffs not to come to office last Saturday (they have a special agreement and additional fees to work on every Saturday) while at that time his boss is out of city and the supervisor is all day meeting. He instructed how to answer if the boss asked so that they pretended that they were in the office. Now the boss found out and gets very angry until this moment, all the staffs has apologized with the boss except him.

He's actually a friend of mine. I am the one who recommend him working there. He's not getting fired yet. The boss is still considering it and i have told the boss to do whatever he thinks the best, i don't want to get involved.

The penalty is whatever his boss, and his boss's boss, wants it to be - firing, suspension, demotion, or no penalty.

His actions would be classed as Industrial Misconduct and the consequences can be anything the company wants, from a warning up to and including termination of employment.
Any staff who lied or attempted to deceive the company in any way shape or form may be legally subject to the same, which includes termination of employment and possibly a lawsuit against them.
If the Company feels it should start litigation against any or every employee involved it is legally allowed to sue for any monies lost through the employee(s) actions.

He should be terminated. He has broken the trust relationship with the employer. He is not management material.

He'll get canned. Maybe. So what? It wasn't you. I'd follow company policy, be polite to him, and be polite to his boss. I would try not to get involved, entangled, or gossip about it.

well, it'll come down to who told them to say or do this and all fingers will point back to them. in that case, no more employee, but soon to be fired employee.
