I have a pending misdemeanor allegation and am going through a bunch of job interviews. They love me, but when they run the check the pending litigation comes through and they won't hire me. I need to find a company that does not do criminal background checks.

Usually it is the smaller companies that don't run criminal background checks. But for a misdemeanor, it shouldn't matter. If the employer is that worried, it would be best to say "Will discuss in interview" on the application. Then go to your local One Stop or the LMI (Labor Market Information) website and get a WOTC form (Work Opportunity Tax Credit) for the employer so they can get a $1200-2400 tax credit for hiring you. As far as reference checks w/past employers we are only going to be concerned w/your most recent employers. Preferably we like a reference from your current place of employment, if that is not possible then the employer before that. The only time we will go really far back is if you've been w/your current employer for a long time and you don't want us to contact them, or if you've been unemployed for a long time and your most recent employer is from a long time ago - now this is for a typical employer. However some companies like the FBI, or other jobs that may require you a high level of clearance, they will dig as far back as they want. When it comes to your criminal record, whatever you have been convicted of will remain on your record, when you do a criminal background check you get a criminal record and anything that you were ever involved illegally w/the law (unless it was expunged) will be on there, and we will see it. However, whether it is damaging to your chances of getting hired is up to the employer to decide. HR Manager

Why don't you tell the potential employer "BEFORE" they check - because it's more likely that they think you're lying by omission.

Also, it's a misdemeanor not a felony, so see if you can get it pushed through - convicted of a mis won't hurt as much as being in process.

I grew up with my biological Mother and Step-father. I have only ever talked to my biological dad a couple times till recently. All I knew of him personally when I conducted the search was his full name, and the state of a previous address he used to have.
When the results came back based on the minimal info I had, It pulled up a current address even his phone number. When I called the phone no., I heard the voice of what sounded like it may be my step-brother. I asked if Joseph(my bio father) was present, and he said no but to try back after 7.
I haven't done anything with the info since, But yeah I found what I was interested in.

You may have to consider smaller more entrepreneurial firms who are lean and mean and don't do the checks at all.
