like say if a 17 year old had sexual intercourse with a 13 year old, wouldn't there be charges against the 17 year old even though he is a minor (even if the sex was voluntary)?
I've always thought that it was illegal, but is it really?
cause my best friend is having sex voluntarily at 13 and i thought that minor-minor sex was illegal.

The only way this could be even considered a statutory rape it would have to be reported by the 13 year old's parents and charges filed. If not, then there's really nothing that can be done. Technically, the courts would look at this by the rule of 7's and your friend is under 14 so he/she can not legally consent to anything because at that age, they are still considered "innocent."

They don't lock up minors for having consential sex with each other. You'd have like half of each high school locked up.

I'm no lawyer, but statutory rape is statutory rape whether it is consensual or not. If you are not over 18 it is a crime.
