Do not ask questions about the following:

Family issues – no questions about children, or marital status. You may not ask “Are you planning to have a family? When? Do you have, or plan to have, children? How old are they? Do you wish to be addressed as Miss, Mrs. or Ms.? What is your maiden name? Have you ever had your name changed legally? This job requires short notice overtime (or travel, etc.) Will this cause any babysitting problems for you? Who is the nearest relative we should notify in case of an emergency? Are you married? Have you made child care arrangements if you get this job? Are you gay?”

National Origin questions – You may not ask “Are you a U.S. Citizen? Where did you grow up? Where were you born? Where were your parents born? What is your native language?”

Age-related questions – You may not ask what year they completed/graduated from high school or college. “How old are you?”

Religious beliefs or Practices – You may not ask about their availability for work or need for accommodation due to religious practices. You may not ask what their religion is, nor what religious holidays they may observe. “What religion do you practice? Which religious holidays do you observe? Will your religious beliefs affect your ability to work overtime?”

Criminal record – You may not ask if they have ever been arrested. “Have you been arrested?”

Disability related questions – You may not ask if they have a disability, or ask the extent of their disability. You may not ask “Do you have a visual, speech, or hearing disability? Have you ever filed a workers compensation claim? How many days did you miss from work due to illness last year? Do you have any medical problems (disabilities, etc.)? Have you ever been turned down for a job because of physical reasons? Do you have AIDS or any other infectious disease?”

Economic status – You may not ask about wage garnishments, personal bankruptcy, home or car ownership. “How long have you been at your current address? Do you own, rent or live with relatives?”

Don't ask them anything concerning their race, religion, sexual orientation, if they are married, how old they are, if they have children. Stay away from anything that seems personal. Remember, it's business.

anything based on race, religion, creed, marital status, or personal life...like sexual orientation. Anything that would be considered discriminatory.
