My boyfriend received a notice from the Dept. of Rev. today, letting him know that over $300 a month will be taken out of his paycheck. The letter stated that he owes over $5,000 in back child support. The problem is..........he had sex with this woman once, and this is the first he has ever heard of this child. What does he do? This is court ordered that he pay. (By the way, we live in FL.)

In all states, child support or child maintenance is the ongoing obligation for a periodic payment made by a non-custodial parent to a custodial parent, caregiver or guardian, for the care and support of children of a relationship that has been terminated.
In most jurisdictions there is no need for the parents to be married, and only paternity need to be demonstrated for a child support obligation to be found by a competent court.
I think that your boyfriend's ex unwed mother petitioned the court for a determination that he is a father of the child.
He must petition court at her residence to deny paternity and reverse judgment. No paying is not the solution.

Get a lawyer ASAP. Once they start assuming that it is his child it will be hard as Heck to get this reversed. In ohio in one case the oder was reversed after DNA test but he couldn't get the money back that had already been paid. They may have sent him something in the mail to an old address. If he didn't show up they tried the paternity case without him and found him guilty. Now that they located where he work they are going to take money out of his check.

Tell him to get a paternity test to prove or disprove it. That's the only proof of him convincing the court. Seek a lawyer's help.

No, they gained't provide up the order till the two considered one of you get married. Voluntary help sound stable, all of us working mutually for the income of the toddler. notwithstanding, in case you have a combat, he strikes out, etc. He could provide up paying and you will possibly have not have been given any recourse. because of the fact the county/state has considered all of this interior the previous, they're being proactive to steer away from later courtroom battles. in the experience that your boyfriend is keen to assist his daughter, he shouldn't cringe at having this help legally documented. it is likewise to his income. interior the form which you separate, if his help is legally documented, you won't be in a position to declare that he's not paying whilst he unquestionably is. i be attentive to this sounds dreadful, yet those issues bypass the two strategies. Deadbeat dads who do not help their toddlers; and scammer mothers who acquire money and declare they don't with the intention to get the dads in difficulty. maximum suitable for each individual in contact if the money are paid in the process the state gadget.
