YES it is. Techically if you walk up to someone and scream threats at them without touching them all they have to do is tell the grand jury "i was afraid for my life." then you're going to the Rump Ranger Inn on an aggravated assault charge.
Striking someone with the intent to cause any kind of hurt whether emotional or physical is calssified under assault if they feel their life was threatened then it's aggravated assault.
Check with your local DA but that's the standard ruling oh and if you do it and they grab you before and you can run and beat you bloody that's self defense.

If law enforcement in your town is really hard up to book people, you might be charged with Criminal Mischief for damaging (by knocking it to the ground) the cone (his property). That is a class 3 misdemeanor. But really, its just not nice.

It's a moral crime. It the person is hurt it could be a crime. I wouldn't recommend doing something so Jr high - though.

I believe it would be simple assault...depending on the state you live in. In any state it would be considered obnoxious, rude, disrespectful, mean and extremely childish!

A seagull did that to me in St Ives and he wasn't prosecuted for it, but I think they shot it the day after.

Legally, yes it would be assault, maybe even assault and battery. Assault can be just touching someone; spitting on them would be assault, too.

Very childish. How would you feel if someone did you like that. Oneday your going to do that and someone is going to chase you down and bet the crap out if you and you'll be left standing there crying...haha
