Okay I know this guy who stole blank checks from his mom he filled out some $300 worth of checks and cashed them. But he got his girlfriend to fill out the first one for $100 because he didnt know how to fill out a check. She filled it out then he left and supposedly cashed it at a later time. Could she be charged with anything b/c she filled it out and signed it in his moms name?

This all happened in Georgia.

All parties involved in check fraud could be charged with check fraud. Check your local law enforcement or go to findlaw.com for laws in Georgia. A friend of mine knew a friend of hers cashing fraudulant checks and she served 6 months in jail. It just depends on the penalties for that type of infraction in Georgia.

Did they have a gun? Or just threaten you with violence? If they had a weapon and were pointing it at you, clearly you had no choice. Did you do anything after the fact to report the incident? Or just acted like it never happened, and not attempt to catch the person before they cash the check.

At the very least I would expect that if the friend's mum wanted to she could have her charged with aiding and abetting. The girlfriend could possibly state that she was unaware the cheque (check!) was stolen, but that would be difficult to prove as she would have to have forged a signature to do so.

Both can be charged with the fraud. Each check would be a seperate charge.

They could both face charges. Him with theft for stealing the checks and her for signing his moms name. She may be hit with the whole crime if he denies stealing the checks. They may charge her for that too.
A lot depends on if his mother presses charges.

Technically, she would be at fault for the one she did fill out. I would imagine she will not get in near the trouble he will be in. The intent of the criminal is usually a factor sentencing.

. She could probably be charged as an accessory to the deed.
Not to mention why would you show someone how to do it? You knew it was illegal!
