I purchased an item from a retail store that looked defective and was not as expected when it arrived. When I told that to the salesperson they actually tried to physically "fix" it changing the appearance of it somewhat. Am I responsible to take this item? I did not realize it was a "special purchase". Signs are in the store that I did not see when I purchased. Filed complaint with BBB and now being harrassed by merchant by phone nasty phone messages. Three in
a two week time period.

File a complaint with your State's Attorney General if the sales person is leaving you harassing messages.

You can try contacting the manufacturer directly if you can't get anywhere with the retail store. Some stores cannot return customized products (such as something that was engraved or personalized). When ordering such items always make sure that you give as much detail as possible so you get what you want. Still if the product was not what you had ordered or had been altered by the store you should be able to return it. If the phone harrassment continues you can report them to the police.

You are not responsible for a special order if it's not the item you wanted or ordered and if it's defective or broken, especially if it was tampered with by a salesperson.

"buyer beware".... if it looked defective, you should not have gone forward with the purchase. some managers will waive that rule if you are nice about returning it. try not to sound accusatory when you talk to them.
