In creating an application form for Human Resources, the concern is really about an application that asks for Race and Gender??

Race and Gender are ok to ask on an application. Especially if you are a company that adheres to Affirmative Action. However you decision can not be based on Gender or Race. So be very careful how you conduct your interviews and above all when discussing a candidate's attributes or lack thereof "CLOSE YOUR DOOR. Even a one word slip can cost you millions.

You can ask gender, but you cannot ask marital status. This is because if the applicant is a female and married, a lot of employers may want to turn her down for a job b/c they expect she will be pregnant at some point and go on maternity leave. While on maternity, they can't fire her but have to pay the benefits and give her the job back when she ends maternity leave.

You can ask month and day of birth, but not the year of birth. This is due to age discrimination issues.

F.Y.I. You're also not supposed to ask these 2 things during the interview process either.

You can ask those types of questions on the application, but they cannot be a basis for hiring or not hiring ... you can use them for statistical information ... even if they are on the application, the applicant is not required to fill it out

Race and Gender are ok...but could lead to a discrimination law suit if thy can be proved to be a determining factor in hiring. Personal questions are a no no...for instance asking "what magazines do you subscribe to?" or "do you attend church?" or "have you ever contemplated suicide?" or "do you have any relatives in prison?". Get the drift?

The above answer is correct. You also can't ask anything about marital status, kids, etc.
