Well, you know, if your ancestors came over on the Mayflower, they were illegals! What is more important, human life and freedom, or immigration laws?
I think that to avoid legal trouble for yourself, you should help your employee to become legal. If that is not possible, you should seek to help him ethically anyway. Remember that he came over to the US for what we all want - a better opportunity. Illegal immigrants, ironically, are the epitome of the American dream.

You need to report him because I think if an employer knows his/her employee is an illegal immigrant and they still let them work for you then you can be arrested or something like that. If people are so desperate to be an American why don't they do it the right way?

Was - meaning he is legal now? Do nothing.

If you mean IS, then decide if he is a good employee and help him attain legal status. Else, quietly dismiss him to avoid legal problems for hiring illegals.
