yes, they have the right to do this. they even have the right to give you a DUI if your keys are in the ignition and the vehicle is not running! If you're gonna drink DONT DRIVE unless you don't care about the fine and jail time.

Yes. It is called 'Care and Control'. Police can use this method to arrest any DUI suspect and charge him as 'disorderly' or 'drinking in public places' and give him breathalyzer test.
If the police observed the driver as a suspected DUI then, for safety sake, he does not have to chase him right away but arrest him later when the person stops (even to take a leak in a doughnut joint, for instance).
If the DUI person has the key inserted in ignition (even if the car was not started), they can take the key away and arrest the person.
A drunk driver should not be seen by police sitting in the driver seat. Period. Yes, they are strict and law allows them.
OH yeah, it is brutal. No excuses for d & d. (drink & drive).

as long as they can prove you were driving you can be arrested. One night I got home and this guy was right by my driveway, in his car driver seat, door open, dome light on. I got home, was a little nervous (it was late like 1 am and I was a woman alone). After an hour the guy was still here. Well, I called the cops. He got arrested for DUI. He was at a party on my street, started to drive home, pulled over to puke and passed out there with the door open.

Can you be arrested for robbing a store in front of a police officer, if you have already exited the establishment?
Don't know about USA, but in Canada you can be arrested for sleeping in the car drunk, while in possession of the keys. Care and control of a vehicle while intoxicated is illegal also.

If you have any auto keys on you or if you are in a parked car in the drive seat with the engine off and everythin they can still arrest you because you have the means to drive drunk! its to protect you and the other drivers on the road

If the officer saw him driving, he can arrest hime. Period. If not for a dui, then public intoxication.

yep, they can do this. In fact they are encouraged to do this so that they don't endanger lives in a police chase. Good for them.
