she lives about twenty miles away. her and my dad are divorced and she has her own house with my stepdad. i'm really unhappy here with my dad. please tell me how she can win custody! lawyers, if you're out there, help!

1st off how old are you? Are you over 13 or 14? At that age....you can petition the courts to modify your custodial parent. If you MOM is in agreement with you living with her....talk to both your parents and maybe something can be worked out ...Maybe a trial living arrangment can be done.

My question to you is why didn't your MOTHER receive custody of you? Most of the time Mothers receive custodial custody with joint custody shared between the parents.

Ask your parents to sit down and talk with you. You might think the grass is greener at your MOMS but ...sometimes there are lots of weeds underneath that layer of what you perceive to be comfortable grass !

How old are you, Ocean?
The Courts sometimes let a child decide if theyre of a certain age, like 14 or 15. If youre younger than that, its possible you may not have a choice.
If you are, your mom can make a petition to Court on your behalf, stating that you want a hearing to state where you want to live.

First of all-how old are you-and what state do you live in? There are laws varying from state to state and if you are 12 or older you may have the choice to live with your mom without your fathers say so. Check into it if you are that unhappy-your father needs to do what is best for you and nobody else-so be understanding too-it's got to be rough on him to have you go elsewhere to live! Good luck!

When my ex and I broke up I had custody of our son. A couple years later he took me back to court. At the mediation hearing my ex was granted custody. The judge told me to save my money because my son had solid reasons for wanting to live with his dad and he talk maturely. He was seven.

You can file a petition on your own pre-will in court taking cognizance of the case, stating that you would like to be with your mom.

just tell the judge who you would rather live with and why, your old enough now to have say in that kind of thing I believe

first call your dad to sit, and talk to him in a matured manner, if he will allow you to go.if he refuses then take some elders or maybe one of his friends to help you talk to him ,if he stil proves sturbone, then you can take him to the court maybe with the help of your mom.

you have to talk to someone from social services,they will evaluate the situation and take your wishes into consideration and present their evaluation to the Judge, this does depend on how old you are also..
