ok, this is kinda wierd. my dad was "given" a small pickup truck as payment for some work that he had done for this guy. the guy didnt give him the car title. now i want to drive this truck because no one is using it. i got the insurance and everything else but the tags aren't up-to-date, and i know you need the car title to get the tags and registration in order. my question is, can i go over the original owner's head and get this thing done? if i can/can't what do i need to do?

The term "given" means he "paid" for work on another vehicle with the PU, if I am reading your explaination correctly.

If you Dad gave the man a receipt for the transaction it becomes a bill of sale. You must go to your states DMV and place a mechanics lien on the PU. Once the execution of the lien is complete, about a month in most states, your Dad must then apply for a new title in his name. He does this with the executed lien paper work and a "statement of facts". It will be processed over the period of about 4-6 weeks. The DMV will investigate the "claim" of ownership by your Dad during that 4-6 week period. If the "claim"/mechanics lien is not disputed during the investigation, you will usually receive a new title at the end of that time. If it is disputed there will be a hearing to determine ownership or the DMV will refer your Dad to the courts. If the value is under $5000. in most states it will be Small Claims Court. If it is over $5000. then it will be Municiple Court. In either case a judge will determine ownership. Then it is back to the DMV with the courts paperwork for a title if you prevail in court. Nope, he needs to sign the title over to your dad. This was a fishy transaction because the guy can now file the truck as stolen and get whoever is driving it now arrested.

as long as it was not reported stolen, you will probably need a bill of sale that was signed by the previous owner, and notarized.... just take this in to your dmv, and tell them that you need to get the title transferred, and get a tag... you will probably have to pay back taxes on it.

otherwise, you can file for abandonment, but they will have to send a registered letter to the registered owner.

go to your DMV or most places have a tag office and tell them your want to switch it over in your name and they will ask for a bill of sale which you and your father came make up just have the guy sign it saying that he in deed gave you guys the truck and then you pay for a tag transfer and boom it's in your name ~~~~Good Luck

it is still the other guys car & until he signs a title deed over toy you, he can still claim it back at any time.

well it depends on the laws in your state but they have to release the title to you.
