If a child (16) has been sexual harassed at her work place. She has gone to HR filed a complaint, and investigation insued and the offender has been fired, and this happened months ago, why do we (parents) only hear about it when she finally tells us? Do we have a legal right to employment records? Because she is a minor, cant we file criminal charges against the individual? Why were we not informed. She said she signed an affidavit and everything but wouldnt we have to counter signe since she is a minor?

Well since the incident is long over and the offender has been fired, I'd say there isn't anything you can do about it. Sexual harrassment in most states isn't even considered a crime unless it goes so far as to involve unwanted touching. Making rude or lewd comments is definitely dickish behavior that can prevent people from doing their jobs, but it's not illegal. Your daughter handled it correctly. She acted like an adult, good for her. Maybe you should tell her you're proud of how she handled it, but that if something like this happens again, you'd like to be informed as well. Since she wasn't under arrest you didn't need to be involved. If she was taken to the police station, and she requested either a parent or a lawyer to be present before signing anything, then you have to be there. But she can make a report and sign an affidavit without you.

I currently work for the local police department as an office assistant. I handle these kind of things all day. Plus I just served on Grand Jury and we had a similar case come before us, but touching was involved in that one.

In cases as a minor if it went to legal proceedings, then yes you would be notified. However, she took care of it as a mature adult and it was solved. (Good for her).

Reading and responding to your updated question about it being physical. I strongly recommend your lawyer and going to the DA.

She wasn't told because her company doesn't act 'in locus parenti' and she chose not to tell you about what she'd gone through until she was able to.

If you feel a crime was committed, call the police. They will come out and talk to you and they will let you know if they'll pursue it.
