We had previously bought a lot that turned out to be in "flood way". We can't even clear the lot without permission and it can only be used for picnics!

Go to the county court house and get a plat map, that will tell you if you can build on it.

Also, if the person who sold the other property did not tell you about it being a flood way, you may be able to force them to buy it back
