i just had a little accident. and am confuse as to who is at fault
heres what happen: i pulled into this parking lot to drop off a friend, the lot is pretty small theres only enough space for you to back up when parking. i was backing up to get out. this other lady was coming out of the parking (by all this i did not see her, nor she did me) am backing up .....next thing i know we hit each other, ofcourse she in pointing fingers at me. but i was like well i had the right of way since she is parked, she should have looked both ways before pulling any further. now i dont know what to do i really dont wanna go thru the hastle of the insurance deal(we got each others info.) but i guess am gonna have to, i got most of the damage, she just got a cratch that could be (she says) buffed out. by the looks of my car they are gonna have to take out the bumper repaint and place it back properly (its a bit outta place)
please YOU let me know...was it my fault?

Wasn't there. I'd like to believe you. Call your insurance. Tell your story. You'll be surprised how much her little "buff" can cost! Since no tickets were issued, you cannot be found at fault.

I've had fender benders under the same circumstances. My insurance did not go up because I could not be proved at fault. I could have chosen not to have it repaired, but vain about my car as I am I ate the deductible and had it fixed.

Call your agent TOMORROW. They will protect you (actually themselves- they are incredibly stingy!) and deny her claims. If they don't hear from you first, well it could complicate things. You better believe the woman probably called her's on the way out the parking lot. You also have 10 days (in most states) to file a vehicle accident report w/the state. Any police station has the forms. Fill them out and mail them in, it will not affect your driving record.

Accidents happen. Don't be afraid.

It sounds to me like it was more her fault than yours. But I mean it was an accident that is what we pay all those high premiums for. From a strictly legal point it is going to be her word against yours. I wouldn't sweat just turn it into your Ins. company and go on. DO NOT ADMIT FAULT in any circumstance....no matter what. Let the insurance companies figure that out...

Tip for the wise, NEVER say it is your fault. Don't even think it is your fault. It's something that will be investigated. And since you had most of the damage that would appear it would not be your fault. In most states tho, you are at fault about 10-15% for just being there. That would usually cover your deductable.

You didn't get a police report? Your word against hers? Report it to the insurance and risk your premium going up a bit?
Have the money to fix it yourself?
I think if it was over $500, I'd report it to the insurance, and let them sort it out!

In order to file an insurance claim (at least in my state) you need a police report. The police officer should determine who was at fault.

I know what will happen. I want to say you are in the right, and I want to say you will win, but I will say instead that you will probably lose because she will say that you never turned or saw her, or that it was all your fault etc etc and then it is your word against hers. Get a good lawyer.

It sounds like it was her fault if you were already pulled out. But, in a situation like that it would be hard to prove that you were already pulled out and she wasn't.

its your fault look both ways because you have to be the defensive driver because other drivers are careless and you have to protect yourself against other drivers , so it is your fault get lawyer ed up because she is gonna make ya life miserable
