what are the penalties on a hit and run charge when the cars involved have only a slight paint damage. no cracks or dents....are there any penalties? who would you be in trouble with? the other party has agreed to not involve the insurance co's. it is the first time involved in any kind of traffic violation.

If there are no injuries, the police will try and get the hit and run party or the owner of the car to come in to talk to them and give a statement. Once that is done misdemeanor charges can be brought about in court and the license is suspended with community service and a fine...

I don't understand how it is a hit and run if the two of you know each other's information. If you hit another car and settle out of pocket, you need to understand the other party is entitled to take the vehicle to the body shop of their choice and you are responsible for all damages, as well as a reasonable rental vehicle if the other person needs one. If he takes your money and changes his mind, he can still file a claim with your/his insurance co in which case whatever's paid out will need to be reimbursed. If you do exchange funds, make sure you have documentation of how much was paid out (get a copy of the cancelled check and write on the memo portion, "For repairs of damage caused 09/"---"/06), so if it goes further you have a record of payment.

pay the person you hit before you go to court and ask them to drop the charges. i dont know if its them as the plaintiffs or the state, i dont know how all that works. but it would be best if you had the matter settled with the person you hit before the court date.
