Can you prove that she got it from the hospital? Many people are carriers of MRSA and are not aware of it - only if you can prove that it was a nosocomial infection would you be entitled to any compensation from the hospital, and even then it would only be if she sustained damages from her exposure.

Stuff like this happens. Its never nice when it happens but it does. Why sue? If you sue too much eventually there will be no doctors, and your fiance wouldnt have had the operation, and could have died.
the only thing special about mrsa is the fact that it is resistant to a few pennicillin derivatives. it is possible that she could die but to be fair there is a number of other infecitions she could have caught. up to 40% of people carry MRSA so frankley you'll have a hard job proving the doctors were neglegant and that you didnt give it to her or any one else...or infact she didnt have it in her normal flora.
your entitled to be upset and weary but its not really the doctors fault...however bear in mind you also have a choice of hospitals to go to so therefore you shouldhave checked the cleanlyness of the hospital she went into.

The burden of proof in this intense will fall upon the plantiff to demostrate that the MRSA was acquired in the hospital. While it is true that MRSA orginated in hospitals, it is now widely spread in the community. I am not stating that the infection was not transmitted in the inpatient facliity. It is possible that your fiance had the organism on her skin or perhaps you transmitted it to her.
The consent form she signed for the procedure clearly states infection as one of the known complications. The Centers for Disease Control has some good information at the site below.

Of course you can but think hard on it. Its this kind of thing that is eroding our culture, its people sueing hospitals which means they dont have enough money to keep the hospitals properly and that puts other people at risk. If she gets sick by all means try to cover yourselves butotherwise what harm is done?
Hospitals are the worst place to pick up infections but they need money and resources to combat this pretty much impossible problem. A hospital is a building full of sick people, cross infections are bound to happen.

god im so sorry, yes mrsa can be deadly. im not 100% sure about this tho. you are best asking a solicitor for free legal advice on this one. before your fiance had the opperation she would have signed a consent form ... which of course no one reads properly and is full of small print - i have no idea what i signed when i had mine cas was in so much pain at the time. something may be in the small print about this aswell.(we have those here in england - dunno where u are)
thing about mrsa is that we all carry the bacteria on our skin anyways and it can cause trouble for some when its in an open wound. and i dont think unless any serious damage has come to her that anything can be done.
thats just what i think but id get advice from a professional on this matter

it will be very hard to prove that she acquired MRSA in the hospital. it is commonly found outside of hospitals these days.

msra can happen anywhere. chances are she had it prior to the hospital visit.....
you could sue, but doubtful she will win. just because hospitals are "clean" does not mean that diseases are not present.
