what is the best way to get city of ny to remove an old tree ?
We bought a house in Queens NY. There is an old ugly looking tree right in front of it . the tree completely destroyed the side walk. We want to get rid of it and plant another tree in it’s place. However city would not remove it because it is still alive. What are the legal options? Thank you!!!!!!!!!!!!!

Get together with the people who have the same thought to you and set a meeting with the authority in charge for this issue (you can call City Hall first to find out who you can talk to).

If they still ignore you with this decent idea, well, making a protest or a demonstration in front of the city hall is not illegal either.

Deny that anyone here ever gave you this advise.

Go to an old fashioned hardware store and purchase one dozen large copper nails.

Climb the tree.

Into each large branch drive one copper nail. Drive the nail verticaly down, not from the sides or bottom. Paint the nail head with brown or gray paint so it is not hugely obvious.

The tree will die.

Then you can contact NY for proper removal.

have you done research on what sort of replacement tree to plant? do you know the charactistics of the various species and how they grow and what they will do to the sidewalk and street?
have you considered how much shade and coolness you are getting from this large old tree and how many decades it will take another tree to provide the same?
have you considered how much pollution the tree is filtering out and how much pure oxygen it is adding to your yard?
what i think you should consider is approaching the city about repairing the sidewalk, not taking out a valuable tree.

Bureaucrats don't respond to words like "please".

Instead, they seem to respond more to words which carry possible liability to THEM

Words referring to the removal of the tree as "critical" , and the tree as a "health and safety hazzard" might cause them to think differently.

Also, the Americans with Disabilities Act requires all sidewalks to be free of "obstacles" and "dangers" to the disabled person's "quality of life"

A photo of a person in a wheelchair, struggling with the damaged sidewalk, might get their attention!
