The Indian claim centers on the agreement between the Dogra Maharaja Hari Singh, Prime Minister Jawahar Lal Nehru and Lord Mountbatten according to which the erstwhile Kingdom of Jammu and Kashmir became an integral part of the Union of India through the Instrument of Accession.
The democratically elected Constituent Assembly of Jammu and Kashmir had unanimously ratified the Maharaja's instrument of Accession to India and had adopted a constitution for the state that called for a perpetual merger of the state with the Indian Union. India does not accept the Two Nation Theory that forms the basis of Pakistan.

The interests of the people of Kashmir would be best served if it stayed with India. India is dominated by Hindus, who are far more tolerant by their nature than Muslims.
As part of India the people of Kashmir would have religious and other freedoms they would not have under Pakistani rule.
India has a large Muslim population that by and large lives peacefully in the largest democracy in South Asia.

Kashmir was given to the Pakis when Nehru, Jinnah and other sat down to draw out the border lines for India and Pakistan.
However, Kashmir was rich in resources and tourism and Nehru was against the idea of it going to Pakistan. therefore, he forcefully sent his troops there and they are there till today.
Another law states that Kasmiris can choose to be a part of the country they like - and they did choose to be with Pakistan but noone listens u kno.
I don't think India would be able to handle Kashmir cuz as it is many other communitites are trying to get away from India. Like the Sikh Punjabis, the Tamil Tigers etc etc.
So many other communities want independance besides Kashmir....but now its a mater of ego....

Bloody BLACKMAN dare not say that Kashmir belongs to America. Kashmir belongs to india, even pakistan is. Pakistan is the illegal child of india rem that. Kashmir belongs to India and will do forever.

Kashmir is to Pakistan what Cyprus was to Greece.
In 1974, Greece was stupid and Turkey took away half of Cyprus.
If Musharraf acts stupid - Kashmir returns to India and someone else takes his place with the new reality.

Pakistan,
the Indians fabricated a silly story and took over Kashmir illegally.
Actually it should return to a sovereign state independent of both Pakistan and India.

Kashmir is a pass unto itself and should just be there and stop fighting over it no one will ever concede too bad it can't be used as a unity passage to each country instead of a divider
