I was driving from work to my house when a construction truck out of no where crossed my lane and I strucked him. I was driving an acura integra and the front was totally damaged. I contacted a lawyer and when he got the police report, it said that it was my fault, do I still get money from the accident. I was hospitalized, and I got a damaged foot, some neck, knee, wrist injuries. So do anybody think if I could a receive any money? and a estitame of how much? Thank You.

Sorry to hear about your case. You are likely to be liable for this accident. Police is unlikely to change their report.

Since it's your fault, you will not receive any money for damages.

My husband is a police officer and I asked him what he thought. If the truck crossed your lane, coming from a different lane, it would depend on our the intersection was set up. Did you have a stop sign? Did the truck have a stop sign? If you lawyer got the police report and stated that it was your fault, I would assume that he knows what he is doing and since it is your fault, then you get no money. You would receive none, because the police reports shows that it is your fault, you will have to pay him if anything. Sorry. Hope you have insurance.

Any amount of money you might receive would be based on what state you are in, the type coverages you carry on your insurance policy, and the limits of those coverages.
If you live in a state where you have PIP or Personal Injury Protection, it should help. If you do not, then hopefully you carry "Medical Payments" which will help.
The only money you are entitled to, especially if you were considered at fault, is reimbursement for medical expenses, lost wages, and 'essential services' (things you would normally do for yourself but can't due to injuries like mowing the lawn). There is nothing provided for you in the way of "pain and suffering" when you are at fault. Even if the fault were overturned, your right to sue for pain and suffering may be limited either by insurance laws, or by laws in your state overall.
As for your vehicle, your collision coverage will repair or replace it, less your selected deductible.

You didn't give enough information. If the police report states that YOU are to blame for the accident then most likely you will not recieve any monetary compensation. That's the way it works. Whoever is to blame recieves nothing from the other drivers insurance. All you can get is whatever your own insurance might cover for you...IF ANYTHING. But remember. The police report said you were to blame.

Did you get a copy of the original police report? Ask for a copy of what the insurance company got as well. I went 10 rounds with an insurance company over a similar situation. They claimed an accident was 10% my fault (EXCUSE ME??) because I hit a woman who decided to turn left across four lanes of traffic but she didn't look to her left. She pulled out in front of me, so yes, I hit her, but she caused the accident.

If you have the energy to fight it, do it. If it's not too late, and if the truck driver was ticketed, make sure you show up at court on his/her court date to make the ticket stick. Otherwise the judge may toss it out.

Work with your insurance company and tell them you want to fight this. But find out the consequences of accepting any settlement money from YOUR insurance company. You want the truck driver's insurance to pay for everything.

Good luck... it's going to be a tough fight but it may be worth it.

The police take in to consideration road surface time of day skid marks and many other factors like if u hit the truck in the rear panels etc etc Your insurance company will give you the best advice how or what to do.

Same thing happened to me. Thankfully neither my son nor I were hurt. I put an ad in the paper asking for witnesses and someone did come up who saw what happened and he was nice enough to sign an affidavit with my lawyer stating what he saw. The police and the other driver's insurance co. were trying to make it my fault. 21st century never ever acknowledges their clients being at fault so it got settled for it being his fault 75% and mine at 25% (i guess cause i was breathing their air on this earth). I got a lawyer real quick and he was able to get me 5k.

Find out why you were at fault first! Did the lawyer give advice? If you have unisured motor on you policy, you may be able to collect lost wages and bills from your insurance. but not pain and suffering. Could be wrong though.

USE YOUR PERIPHERAL VISION you hit him, you pay to repair his truck...you pay your deductible and you pay your increased insurance rates. but you don't get a ticket for inattentive driving...if the sun don't shine you don't need sunglasses; you don't need to fool with your hair and make up or the CD player or the cell phone...pay attention to the task at hand.

If you struck him in the rear, no matter where he came from it's automatically your fault. No money.
