Just tell him to call the county and they will tell him what to do. He shouldn't be paying if they are back together. He might have to pay back pay. However, now it is going to fall on both of them as a couple.

What you're saying isn't consistent. For one, if they are only separated, then the court can't make your brother pay child support. If they are divorced, they can! Now, if they are back together, do you mean they have re-married or they were never divorced and are now living together again?
The courts are the only ones that can stop your brother from having to pay child support.
P.S. If they were married and never divorced and she got him to pay child support, it sounds like your brother needed a better attorney (if he even had one).

I am a little confused. She filed against him to make him pay child support while seperated, but now that they are together he doesn't want to have to pay any more but, pay the amount owed during time of seperation???
If they are truely back together then this shouldn't be an issue and he should be talking to her about it.
But, aside from all that. If they are legally married and not seperated, then he doesn't have to pay anymore. It also depends on what state he is in.
Again, I question the quality of the relationship and he may want to consider moving on.

Unless they are married and go to court to stop the support he will have to keep paying!! He should pay anyway and not want to stop !!He sould pay all of the back support that he missed also. She can put it in the bank for college if they really don't need it right now. Tell your brother to stand up and pay for the kids HE helped make!!

If they have reconciled and he wants the child support to stop , they must go together to an attorney and ask to have the child support order supressed by the judge that issued it. He may still have to pay any payments he is in arears for but all future collections will stop as of the date the judge kills the child support order

The best advise anyone could give you on this is to contact the child support people in your area and speak to them about this. In view of the fact that they are back together it may dissolve any past do amounts, and stop all child support payments.
To often folks listen to others and get in to hot water. So call the powers that are and get it right!

That is what legal aid is all about because there are to many unknowns here

Your brother needs to go to the department of child support services and listen to what they have to say. It could be that they will negotiate a payment schedule. The fact that they are together means nothing to the government. He has to go make peace with them.

i think that this question should be refered to a local lawyer on behalf of your brother & sister in law. I expect that the court system will likely need to be involved to issue any change in the child support order to the child support enforcement agency. first & foremost, i would expect that your sister in law would have to be in full agreement before this would even be concidered by the courts.

If they are just living together he will still have to pay. If they get married the child support payments can stop, but you will have to petition the court first to let them know that they are married.
