The DA is compelled to address the situation as murder, however, there are laws allowed by state to defend personal property with force. Evidence may or may not be required if there were warnings acceptable to local ordinances as far as trespassing is concerned. Previous convictions or discernible threat findings may apply but ultimately, the DA would have to drop it as there is no precedent to prove that a Martian has the same value as a human where murder is concerned.

You can't murder a non-human, manslaughter also needs a human victim .

The case would have to be thrown out of court as there is nothing in, as far as I know anyway, any countries laws that relates to crimes against martians.

The DA can do absolutely NOTHING. The act of murder is define as the termination of another HUMAN BEING. A martian is not defined as such! Therefore, it is the same thing as a hunter shooting a varmit. Too bad Mr. Alien...

NOT GUILTY. lack of witnesses. it is hard to get across the galaxy to make it to court. hell, most people can't even make it across town to court.
