My ex and her boyfriend are living together. I know it, they know it. I want to try to get my spousal support changed. He is providing income, and I'm living in a rented bedroom. They have rented a 3 bedroom house, and my son is over there 1/2 the time. Suggestions, Ideas?

None of the responses I have read would be correct in my state (Michigan) IF there was a clause that says "co-habitate" in the divorce settlement. If she is living with someone, that would be taken into consideration.

You need to get sneaky here to save yourself some BIG bucks. Either hire a private investigator or do the investigating yourself. You could set up a hidden camera in a parked vehicle & get some footage. Make sure the recording has a time & date stamp and maybe even at the beginning of the recording, show a newspaper with the date on it. Maybe ask neighbors for statements.

I know the laws really need to be updated on this, but until they actually get married, that order for maintenance(spousal support) is going to remain the same unless HER income changes. I know it doesn't make sense, but a judge will not reduce the amount you pay because someone else is living there. The way they see it, is there is no committment yet, and if they change it, what if they break up? Is she going to come back into court and ask for more? Judges don't like to tie up the system and if you try, you'll only be denied......UNLESS you can kiss your ex's butt, explain your situation and ask her to sign away her right to spousal support.....THAT WILL WORK. And unfortunately, that's about the only option you have at this time. I really wish I had better news for you.

The court is there to help protect you both, you need to petition the court and let them know the changing circumstances always. Whether it's a change in pay, her status....ect. There are not too many courts who make you pay spousal support the rest of your life.

Dont be bitter about the breakup. What would your feelings be if the situation were reversed. You shacking up with some hot chic with large boobs and a great curve? She thinks its cool because it pisses you off.

Send a registered letter that they will have to sign for and you will have on record. Send it on several occasions and eventually the pattern should show that they actually do live there.

The law don't care. She can shack up with anyone she wants and there is nothing you can do. Heck she could shack up with three guys and they don't care. Welcome to the new millennium.
