I bought the phone from a credible seller. However, when I went to activate the phone, they said the esn number came up as stolen. Now I am out of over $350 and I don't know if I can get my money back. Where can I get a another one for less than the $450 that sprint is charging me?

You should be able to get your money back through the buyer protection policy.

Here's some links that should help you get the process rolling, a link to a forum disscussion on ebay about the same issue.

In the future try to check the feedback on sellers & don't buy big ticket items from sellers with low points. Most sellers are pretty honest on ebay, but the ones who aren't ruin it for everyone. & the ranking system & feedback is one of the few ways to determine honesty. So your best bet is to buy on ebay again, but look for a power seller so you get what you paid for.

Because this phone is unusable the seller has to
1- refund your money.
2-swap the phone for the same product.

Go into eBay's Items not as described section.
If the seller refuses to refund your money you can put in a claim.

This is one of the reasons why I won't do business on ebay. It's a scam in my opinion.
