we live in ky & i have a 1 yr old daughter. her father is bad on drugs & never had much to do with her he got visitation so his mother could see the baby well for the past 3 months neither of them has been visiting with the baby. him & his gf went to jail thursday him for dui, assault 3rd on a probation officer, resisting arrest, fleeing & evading on foot his gf went for assault on a probation officer then had resisting arrest hinder prosecution & hinder duties added to her charges. he has never paid child support & only got visits so his mother wouldnt cut his financial ties. social services have taken his sisters 3 kids out of the home because she is currently in icu for overdose. his new baby was temporarily give to gf mom since their both in jail what can i do to get my baby away from this she has serious medical problems & doesn't need the stress this guy is crazy he tried to hit my car w/ weedeater what time baby was in it PLEASE HELP

the visits are supervised by his mother but as far as support in ky it is considered contact if he pays support which he has never done.

the lawyers around here say they cant do anything i have to wait until he has no contact for a year

he hasn't attempted to see her in 3 months. i have a very reputable lawyer & he said that right now there's nothing that can be done because although it does show he's violent it's not against a minor & that if the judge does suspend visits that when he gets out of jail they'll just continue the visits i'm at my whits end i dont know what is left to do

You need to get all paper evidence together and file for an emergency order to modify parenting plan. You also need to file for a CFI (court ordered child family investigator, may be different in your state) and present all paper evidence to the courts and the investigator. Let the courts take it from there. If your income is within limits you can also attempt in getting a Legal Aid Attorney that can help with the process. In the meantime I would cut off all unsupervised visits, although he may claim contempt later, you have valid reasons as long as you can back this all up with paperwork.

get a lawyer if you cant afford one contact your local dss dept they have a list of local free or sliding scale lawyers, keep a log of all the times he shows and doesnt show up for visititation, him not paying support has nothing to do with visitation, tell the courts about his multiple offenses, they will probably at least make his visits supervised, or may cut ties altogether, but you need a lawyer to clarify the laws... good luck

please forgive me if i sound a little stupid i think you live in Australia so the law is different i am from UK so why don't you come and live in England where you can take your children away from there father and the father cant do nothing about it you can be taken to court here and still leave with the children cos the farther doesn't have any say in the matter but let him miss one payment and the courts will be down on him like a tone of bricks . so if i was you i would pick up sticks and leave and come to UK

My advice is go to a lawyer, Just to talk to one is free and then they tell you what they might can do. Thats what I would seriously do... You can get advice all you want on here, but why not just get legal advice free. Well unless a lawyer reads this. But you really need to get baby away from a mess like that! I will tell you this, Me and my husband are lookin ginto having his 15 yr old son live with us, The mother is fighting for him. Yes I know, he can make up his own mind. But to even get into a judge for him to say he wants to live with us is 750.00 to start, for lawyer fees. But you can have a consultation for free.

you actually have it easy (i meas when it come to custody)
you have all this proof, go to the police officer that he has assulted and get a letter
the court will never give him custody even visitation right
if you fear for safrty just move away and don't give your address to him
