I have been out of work for about 5yrs. and hopefully I will be having a procedure done that may give me back my life! If and when I go back into the work force I am afraid that telling a prospective employer that I had been injured on a previous job will somehow hurt my chances of getting a job. And I feel that I would 'have' to tell them in explaining the time gap since my last job. How would I handle that?

Oh no I would never lie about it I was just wondering if it would be allowed by law for someone not to hire you because of a prior on the job injury. Which was not my fault and the case is already closed I filed for W.C and went the whole route .. thank God.

First, remember that you control the amount of information that you give any possible employer. I have about 25 years of experience hiring people in various states and never can I recall I asked if an injury was work related, it is one of those questions that isn't asked such as age, gender, marital status, etc.

If the injury was related to an accident that was not any of your responsibility such as you were hit by a company vehicle, then be up front and tell them so. If you were negligent and your irresponsibility cased the accident, simply explain that you were unavailable for work due to medical conditions that no longer exist. Don't lie as that is grounds for immediate dismissal without unemployment benefits (in most states) but don't volunteer all the information if you are not comfortable.

Bottom line, tell the truth and be up front. Remember that you control the information but balance it against the reality that if someone or your past company really wants to inform any future employer of the events involved with your injury, there are ways to go about it.

Did you file workers comp? I have found that filing WC can (even though it is not) hurt your chances of getting a job. Think about it, would you hire someone who filed a WC claim, I have seen so many employers do this it makes me sick. All they care about is what are the chances of you getting hurt again, and raising there liability. But I have always found that honesty is the better policy when applying for a job. It may cost you a prospective job, but if you do not tell the employer and they find out, you may get fired with cause. Just be up front and honest.

I know someone who has had several back surgeries over a 3 year period, but he has always gone back to work either at the same job or started a new one which didn't hurt him. I would not ever lie about being unemployeed as most employers know about spine problems. I do know that with today's technologies, employers can find out anything they want to. best wishes
