That depends on the status of the drivers--if they are employees the restaurant had better cover them to protect itself against potential liability. If they are independent contractors, then no, they would cover themselves. You have to determine the status of the drivers to know the answer to this. You cannot just call them independent contractors, for they could actually be employees, it depends on how they are paid, how much control you exercise over them, whether the vehicle is supplied or maintained by the restaurant and so forth. You really need to contact your insurance man and a lawyer to determine what you have here....

probably depends on the agreement the restaurant has w/ the driver. from my experience, the driver is fully responsible for their vehicle expenses (gas, insurance, up keep, etc) and the restaurant pays them a set amount per delivery to offset some of those expenses.

If the person is driving a vehicle owned by the restaurant, that would probably be a different scenario. I'd check with an insurance agent and read the employment agreement very carefully if using your own vehicle.

In some states yes. I have a business and even if an employee uses their own vehicle to drive to get something for my business, they need to be insured by us. This is to protect you. If they get in a wreck and are "on the job" the person they hit could sue you because of that! It is better to be safe than sorry.

Probably not, but it would be foolish not to carry liability insurance. If a driver hit somebody in the course of employment, do you think that the employer could avoid getting sued?

I believe that the type of insurance you would need would depend on whether or not you would be providing the vehicle. If they have their own car, I think it's considerably less responsibility for you.

No, but somebody does, and the restaurant has to have proof of insurance.

Yes, unless they are hired as independent contractors.

They must carry a blanket policy to protect them, not necessarily the driver.
