You're all right...and all wrong. State law dictates what happens as a result of the marriage contract. So...the answer depends on the state.

Sucks to be the person on the loan. That individual is 100% responsible. You can't even bankrupt those things much less give them away in a divorce.

The person who originally signed the contract for the student loan, unless the ex spouse wants and agrees to take it on. In that case, the lender needs to be notified.

Usually the student signs. They're responsible to repay the loan.

When you get married, all debt belongs to both of you. You may be able to work something out in the divorce settlement, but legally, you owe it as if it were your own.

PEOPLE - GET PRENUPTIAL AGREEMENTS!!! You never know where life will take you. Don't end up with a broken heart AND an empty bank account.
