The man pleaded not guilty to the charge.

A jury, having been selected, was dismissed by the judge who would hear the case alone.

The accused declined to give evidence, citing the fifth amendment and his right to silence.

The prosecution witnesses evidence was challenged fiercely by the Defense.

The Judge ruled that there was insufficient evidence to convict the defendant and he was released.

You should do your own homework. As a plaintiff, I would want a judge. As a defendant, a jury. Both answers are for the same reason...but you will have to figure that one out for yourself.
