In California it is actually not legal to sell a car with out a smog check, so you'll have to check your state laws. In California, the car must pass a smog check before all the paper work will go through otherwise the DMV will not process the paper work to transfer title. (At least this was the case 2 years ago. Laws may have changed again)

Yes! Just draw up a sales agreement that states the car is being sold "AS IS" without warranty.!

it all depends on the law where you live. here in tennessee its legal
