Does anyone know what will happen when two people are renting an apartment and one moves out but doesnt take their name off the lease and once the lease is up the last months rent is not paid. I know im still responsible for half, we are suppose to go to court. my question is do i have to go to court? or will they just let me know what i need to do next? and what do they usually do besides tell you that you have to pay back the money you owe.

Do not EVER let things just happen to you! Go to court. If you don't show you lose by default - you already trusted your roomy to do what was right, do you think having this same person represent you is going to go any better? At least state your side so the judge can judge - that is his/her job.

Ususally when two people sign a lease, they are jointly and severally liable. This means that either party could be held liable for the full amount owed. Don't assume that you will only be held responsible for half. Also, keep in mind that the owner may try to hold you responsible for much more than you think you owe. If you don't go to court you can't win. You should talk to a lawyer about holding your roommate liable for his/her half.

2 names on the lease show equal responsibilty in the judges eyes. You should go to court to protect yourself and explain to the judge your side. Quite often you are in and out quickly and will not see your landlord but will see his legal rep.

"Seek some free legal advice if you can get it." Put all your papers together and try writing out what you want to say so you don't miss anything. The person who moved out is not exempt from payments due. Just be warned you could be handed additional fines from the court like paying the legal fees for whom you rented the apt. from.

Usually the rental contract will put down you both name and driving licence, passport etc. together with your post-dated cheques for every month. If your room-mate moved before the last month, he/she had paid the last month cheque, will not be a problem. In case the last month cheque is dishonoured. You both will be charged to court. You pay your portion, he/she pay the portion. In case the rental contract name you both, other party cannot pay, you will be liable to pay the balance. You can appeal.

Just go to court and listen to what they tell you to do and you will be fine.
