Do you think I would win a lawsuit against the makers of Smirnoff? When I was a teenager, I drank WAY too much vodka and got alcohol poisoning.. I was admitted to the hospital and had a huge bill... They told me that drinking was supposto be fun and a good time.. But it wasn't... do you think I would win?

Using the same logic, you can sue the car manufacturers for your accidents and the United States goverment for breaking your legs falling on the ground.
Alcohol manufacturers make what they claimed to make - alcohol. They even put labels on it to warn potential consquences. The danger of alcohol is a widely known knowledge.
One of the major reasons tabacco companies are sued and lost is the fact they claimed to make tabacco but put they added additional nicotine. As a result, what they made wasn't what they claimed.
If you abused the product on you free will, with the knowledge (known or should have known) and got hurt, then you are entirely liable.
By the way, what kind of lables do you think they should put in addition to what is alreay there? "consuming alcohol may not be fun?"

They put a warning label on their bottle to prevent certain idiots from getting such an idea. Besides, a judge would toss the case out because A) teenager means underage, so you shouldn't have been drinking it in the first place and B) which means that you were young and irresponsable, so you have no solid case. The commericials are enticing and meant to show good times, however personal responsibility will always play a part.

Smirnoff would win. The oly person you could even try to sue is the person serving it to you. You wrent supposed to be drinking in the first place,for this very reason. Because kids cant drink responsibly. There are warnings on the bottle ands we all know you have to be 21. What you did was illegal. Even if you were 21 yiou still have to drink at your own risk.

but you were also negligent. probably more so then Smirnoff. you knew that you shouldn't have been drinking at all, but you went ahead and did it anyway
i don't see how a commercial that shows ADULTS having fun makes any difference

Lets make it a class action, I got alcohol poisoning too.
They didn't put out enough warning, I didn't know it was dangerous while I was drinking.
Apple iPod destroyed my hearing also.
Go after the gun companies because people abuse their products as well!

Chances are, you are just looking for a reason to get money. You were underaged, and it is common knowledge that underage drinking is absolultely forbidden.
I think you were being a dumb teenager and should just let it rest at that.

Don't count on it. Sounds to me that you were underage, which means that you were breaking the law to begin with. Additionally, there is some common sense in our civil law system. That would seem to indicate here that you had a choice......and picked the wrong one. We are responsible for what we do, don't you know?
