My girlfriend and I are currently 17 and she is pregnant. I turn 18 on Friday but she does not until late April. I had read somewhere that after she has the child she will be considered an emancipated minor but the source wasn't too reliable and didn't provide too much information on it. The baby is due for December 19th. Does anyone know the facts about this? We reside in New Hampshire, USA. Thank to anybody who can help shed some light on this.

If you have a child, then you are considered an Emancipated Minor if you are over the age of 14. If you are under the age of 14 then you are still considered a minor under your parent's control. At this age, she has options.. Welfare, Public Housing.. etc, depending on wether or not she can get a job.. she will still need someone to sign for utilities and an apartment if she moves out of her parent's home because they don't care that you had a baby at 17. Go to your local human services office and they will be able to give you all the information that you're going to need.

Your girlfriend will not become emancipated just by having a child. Until she is 18, the only way she would be emancipated is to go to court and prove that she is COMPLETELY self-supporting. That means she needs to prove that she can pay ALL of her own expenses all by herself. She couldn't say that she can pay those expenses with a roommate or by living with your family. She'd need to be able to pay those expenses living on her own before a judge would declare her emancipated.
She'd need to be able to pay for shelter without a roommate, purchase food, take care of transportation and health care needs, and all other expenses. To be honest, the process would probably take several months, and wouldn't get accomplished until almost her April birthday.

Here are the requirements:
. Is 16 years of age or older but under the age of majority.

II. Has lived separate and apart from his or her parents, custodian, or legal guardian for 3 months or longer.

III. Is managing his or her own financial affairs.

IV. Has demonstrated the ability to be self-sufficient in his or her financial and personal affairs, including proof of employment or his or her other means of support. "Other means of support" shall not include public assistance, or relying on the financial resources of another person who is receiving such assistance or aid.

V. Holds a high school diploma or its equivalent or is earning passing grades in an educational program approved by the court and directed towards the earning of a high school diploma or its equivalent.

VI. Is not under a legal guardianship or in the custody or guardianship of the state.

VII. Is not under the supervision or in the custody of the commissioner of corrections.

The only other ways for her to become emancipated would be for her to join the military, which she can't do while pregnant, or for the two of you to get married. That's not a good reason for marriage.

Only if your girlfriend can prove she will be denied financial assistance by parents/guardians due to the fact that she chooses not to have an abortion will your girlfriend be considered emancipated.

i don;t think so, but look in your local yellow pages for attorneys. some give free consultations - sometimes even over the phone - ask them and ask what she has to do to become emancipated.
