My husband got layed off last week and when he called the unemployment agency they said they could not send him any money because his company has never filed his wages (he's been working there over a year and they have no record of him at all). My question is - is this legal? And how do we go about getting his wages reported so that we can collect unemployment while he looks for another job? He called his company already and they said they would look into it - but a while ago, we asked them to send us his w2 forms and they never did (despite he called like once a day) so we aren't sure they will even check.
I'm not sure if it matters but he works for a union as an electrician.

Advice would be much appreciated.

If you have copies of the payroll checks, or the stubs you should be able to prove that he worked.

I would call his company and tell them that he is going to call the IRS and tell them the income is not being reported. Thus; they would be charged with tax evasion, theft *assuming they are taking taxes out and disability insurance*

Then report them anyway.

Make sure your husband didnt sign an agreement making himself self employed and not a employee of the company. Your husband could then be responsible for the back taxes.

sorry, i have no idea about your unemployment claim

but where do you live? i know in my area (philadelphia), there is a alot of work for electricians, so much, that my sister's boyfriend quit his job and started working for himself
