Can someone please HELP me with my Family Medical Leave. I like to take 60 to 90 days off from my work due to my health reasons. I have worked continuously for nearly 40 years. My concern is if I ask my employer for Family Medical leave 1) Can he deny this for me 2) If I take the medical leave can my employer terminate my Health Insurance benefits to me and my Family. Thank you for your responses. Any one from H.R can help me with this question. I need this pretty bad.

The first thing you need to do is find out if your employer is subject to the Act.

If you need 60 to 90 days for your health, temporary disability may be a better option.

First, you need to make sure that you medical proof to back that you should not work during that time. Otherwise, you might not be approved for the leave.

Now, company policy differs for how FMLA is handled. But it is certain that you (1) cannot be fired for taking leave unless you extend it without approval, (2) your benefits will not be cancelled although the company does not have to continue paying for their portion of the premiums, and (3) you will have a job to return to although it might not be the one you had, though it will be comprable. Be aware that you might or might not receive pay during the leave.

Your company should have an employee manual that spells out the FMLA policy at your company.

Keep in mind FMLA is required for larger employers (20 or 75 or more, I cant remember which). They do not have to guarantee YOUR job when you return, and they dont have to pay your benefits. They wont cancel them, but they may not pay for them either, depends on company policy. Good luck!

of course they can't fire you ,you should make sure you make this request at least 2 weeks before you plan on leaving you can also call labor board for free advice on your rights.your health insurance will still be with you don't worry
