i have a friend that didn't get to sign the birth certificate and his g/f said that the baby couldn't have his last name because he wasn't there to sign the birth certificate..so is that true..do they have to sign the birth certificate for the baby to have his last name?

I've never heard of that. You can give your baby any last name you want too. My daughters' father wasn't there at the hospital when she was born. I still gave her his last name. Plus, he can always go back and sign the declaration of paternity. Amend the birth certificate and change the babies last name. So, no he doesn't have to sign the birth certificate to get the last name.

No. The mother can name the child whatever she wants when she fills out the paperwork. In fact, she could even name it after some one not related to her, last name and all! This is not true, although mom may be giving him a hard time for not signing it. If he refused to sign it or didn't, the father will be listed as unknown on the actual birth certificate! Not a nice prospect for a child! Tell them to reach the vital records department of the hospital and fix this now before it is too late. As for the name, the mother assigned what ever name she wanted.

You can give the baby any name you wish. He does not need to sign the birth certificate for the baby to have his last name. She was probably upset that he wasn't there. Now that the birth certificate has been signed the baby will need a legal name change to have the father's last name. The details depend on what state they live in.

When my son was born he was automatically given my last name...I wanted him to have my boyfriend's last name...In order for this to happen, my bf had to sign the birth certificate and also sign a waiver/consent form saying he was the father and gave permission for the baby to have his last name. I live in NH, but I think this is fairly standard practice.

The baby can have any last name that the mother gives him. If the father wants to be in the Birth Cert, then he needs to take a Paternity Test and a lawyer. To change the name, he will also need to talk to a lawyer. But if they were never married, it is up to the mother.

its not the birth certificate you can put his name on it if u want
he dosent but he would have to sign something eles if u wanted the fathers last name most sitty guys dont they dont like to support the baby some men

Here in NC the guys dont have to sign it. But thats a problem when a mom can just put any name on it and not know who the dad is. So they can sign the name but need a paternity test for child support if the guy thinks its not his.

No. Sadly , it's up to the mother what happens. There doesn't have to be a father's name listed at all. It's also up to the Mother to choose the bab'ys last name. The fact that he wasn't there has nothing to do with HER decision on what the baby's last name is going to be. She is screwing with your friend. I could have Brad Pitt's baby and give her the last name Garcia if I wanted to

there are papers that have to be filled out in the hospital but since he miss out they can go the the broad of health and have him sign the papers there if he having problems he can go into court and have a judge have his name put on but make sure the baby has his DNA because he be taking care of this child for 18 t0 21 years of age

That is inaccurate. With both of my children, I am the only signer on the birth certificate, though I'm married. I could have named them anything I wanted, it didn't HAVE to be our last name. And you don't even have to name the father at all.
