.... But the rest of the family ISNT? And the dad is just staying with the family?

OK, so here's what happened. A couple of months ago my friend walked in on my friends dad hitting her brother. Turns out the court just dumped him into foster care, and left the rest of the family with the dad (and the mom.) Is this legal?

Yes. The state is allowed to take children out of homes that it believes to be unsafe. Usually the parent who is found to be abusive is put on a parenting plan to follow as a way to earn back the child. If within a year the parent doesn't follow the parenting plan then the parents right to the child are taken away and the child is given new parents. During the year the child may or may not be allowed to live with the parent on the parenting plan. This depends on how badly the parent had been treating the child.

Usually kids who are taken from the home due to abuse are not immediately given new permanent parents. Usually they are placed in a foster home with temporary caregivers. If the state finds extreme abuse then it might speed up the process of taking away the parent's rights.

Sometimes the state finds that one child in the home is being abused and the others are not. When this happens the kids who are not being abused stay in the home.

NO!!! If the father hit one of the children then all of them should be removed from the home...You need to find out why this didn't accure...I know u don't want to hear this but not only should he go into foster care but the other children should too...

Are all the children his? they may not be. If he's abusive, the mom is putting herself and all her kids in danger. It sounds to me the solution is to get rid of the dad and take back the kid. But some women, unfortunately are too insecure.

Shouldn't be. But, according to law, parents no longer are allowed to discipline there own kids. It is called child abuse.
Now, I am going to sound hundred years old. In my day, it was called old fashioned ************ discipline on who is the parent and who is the child. No such thing as 911; child services; so forth and so on.... You were taught to respect your elders. You went to school respecting teachers, etc...

Why would they remove one child and not all of them? That sounds kind of suspect to me.
