Yes, turn the tables and film the drunk and say, Wait till your wife, co-worker and boss sees this on the internet!" But keep the pictures, you can show them to the police so you can file assault and battery charges against the drunk.

They can do whatever they want basically. The club could make it against the rules for patrons to use them, but it won't stop anyone. What they do with the video is another story. They can post it anywhere that they are not making a profit. They may attempt to use it in a civil suit or criminal action. As a former door guy at a local bar I advise being careful and within your rights at all times. But I certainly don't even need to say so right? One in a position of authority would never abuse his power right?

If they are drunk, they may not be capable of using the camera phone. Of course, you want to know if it is legal for them to do so. Generally, it is legal to record anything you could a normal person could see in a public area. What can be done with the recording is another matter.

If they do not have your permission, it is illegal to post any of those videos.
If you by some chance see a video with yourself in it online, you can sue the person.
I too am a security guard who deals with drunk people at the Harvard Club in Boston.

When you're getting ready to kick a drunk's a**, just stop for a minute and ask if he has a camera phone. If he say's no, just start kicking his a $$ up and down the street till he sobers up....
