I assume you are talking about the USA. If the undocumented alien comes to the attention of the immigration authorities before leaving the country and applying for a proper immigration visa, s/he may be deported and barred for up to 10 years from the United States. It is simetimes said that USCIS has ways of finding out when people arrive and leave, but I know that this is not necessarily so, certainly not if they have no reason to check. (Obviously cell phone records, ATM cards, utility bills and the like exist somewhere. But who's to look?) However, misrepresentation on a future application, if discovered, could lead to a lifetime ban.

The assumption always is that such marriages are fraudulent, and the burden of proof is on the applicants to show that they are not.

There are various loopholes and workarounds, but undocumented aliens can rarely use them: assignment as a diplomat or employment by the UN or another international organization.

Your spouse has to apply for a green card for you and you have to apply for an adjustment of status. You can do both at the same time. It takes a couple of months to get the temporary work permit which allows you to work while your permanent residence application is being processed.

Generally speaking, it doesn't matter if he's married ... if he doesn't pass the background check, he's out in either case ... and if he's in this country illegally, e.g. if he's never produced any papers to allow him entry to the U.S., then his chances of staying here, let alone working legally, are slim to non existent ....

Yes he can..but first you have to file the petition to the ins....he will get a permit while his paper work goes thru.

Of course because they are a foreigner so if they marry a citizin of the country then they are considered a citizen.

yep! but i think u should get to know them for when u have to see ur immigration officer and they ask u questions about each other!
