This person could have obtained a divorce on the grounds of desertion by the first wife....
or waited for 7 years before remarrying

But in the absence of both, this person is still legally married to the first wife and the second marriage will not be recognised by law.

The Hindu Marriage Act, 1955 requires all Hindus to be monogamous. Therefore, the second wife does not enjoy the status of a wife.

Also, there is no way that a man can have two wives for bigamy is a punishable offence under Indian Penal Code and one can end up in jail for a maximum of 7 years.

Better still, see a legal expert.

Hindu Marriage Act does not sanction any man/woman a second marriage if the first wife/husband is alive and is not legally seperated from her/his husband/wife. If your first wife left without a legal separation, it means that you were not divorced legally. You could have filed divorce proceedings in a court of law and obtained a divorce on the ground of a long period of separation from your wife who left you on her own for some unknown reason not related to any shortcoming on your part (e.g. impotence) or any act of misbehaviour, torture, drunken behaviour etc. from you. Or you could have also filed divorce proceedings on other grounds like infidelity on the part of your first wife, if applicable. But without obtaining a legal divorce from your first wife, your second marriage is clearly a violation of the provisions of the Hindu Marriage Act. The lady whom you married later is entitled to her passport as per her citizenship rights, but not as your wife.

I think for something like this you need to talk to an expert in the field .. someone from the Department of Immigration. It might also be a good idea to hire a Lawyer who has experience in this field. Good Luck ! :)
