My boyfriend may undergo a court case with his ex. They have two boys together ages 14 and 10 and we are currently paying everything weve got without question. Now she wants to take it to court thinking she will get more but they cant take what we dont got. We currently give $200 a month because I was out of work at it was only his income. Im just curious as to what she can really do. Dont they also consider her income when determining an ammount? She makes more than he does.

Child Support - Guidelines

There are calculators available online that will give you a rough estimate. I think most states are up to 1/2 of his monthly pay. They take into consideration all types of factors. How much both parties make (not you), how much both of the parents bills are, how much she spends on the kids clothes.. All kinds of stuff. You better BELIEVE he'll be paying WAY more than 200 bucks a month for 2 children.

Since you two are not married they cannot legally use your income as a basis for his child support. My Uncle (My mom's brother) got his child support cut in half because she made more than he did and when she would send the kids for visitation they always were dressed in rags so he would have to go spend even more money. He saved all of his receipts stating what he was spending on top of the child support that she was blowing at the bars when she was whoring around.

It probably depends on how much time together he spends with the boys. If he doesn't spend anytime with the kids, then probably as much as possible for support. IF he spends a lot of time with them, then it probably wont be raised.

I think its a percentage of his income. dont think yours should come into it at all...
