Its when an adult has sexual relations with an individual below the age of consent. To prove statutory rape has occurred the prosecution must prove that one person (regardless of whether the act is consensual) is below the age of consent and that a sexual act as occurred.

I believe a statutory rape is involved when consentual sex takes place, but one partner, usually the guy is say 18 or 19, and the girl is viewed by the state as a minor. For this example let's say she was only 15 or 16.

statutory rape is when two minors have sex, if the older child is 18 months older than the person he/she has sex with it is statutory rape, even a kiss or holding hands. if the person is over 18 and does something to a minor it is sexual assault or indecent behavior with a minor. 16 year old sister, believe me i know
