Okay, i have heard a rumor about paying child support, and need to find out if it is true. Here is the senerio:
A man is court ordered to pay Child Support each month. let's say he pays 300.00 a month. But he only sends a check for 50.00. Nothing can be done about it since he is attempting to pay.

Is this true? Can he get away with only payiing part of it? What happens if he doesnt pay the full amount owed each month? I know what happens if a man doesnt pay Child Support at all, but can he get in trouble if he only pays a portion of it each month?

if hes not meeting his payments then i believe child support can stop the ammount direct from his wages, so i would suggest you get intouch with them and see what can be done

He is still suppose to pay the whole amt. If someone is in this situation, i would suggest that they go to the local child support office and let them know. They would be able to tell u what to do and what paper work needs to be filed. He probably thinks that even though he has a court order for 300.00 that sending 50.00 will keep him out of trouble. That is not the case. He has to pay what ever the court had deemed neccessary.

A lot depends on the state you are in. Such as Iowa will not let a man or woman get away with not the correct amount period. Indiana is a little more lenient and they will just put it on arrearage. Then he will be required to pay that till it is all paid even after the child is of age. The one thing for sure is that he is in contempt of court so I would go talk to the prosecutor and see what can be done about it. You definitely want it garnished from his wages. Good luck.

Something can definitely be done because he was ORDERED TO PAY $300!!......not whatever he has available that month. Lets say you got a speeding ticket for $90. You decide to fight the ticket in traffic court. The judge still finds you guilty and orders you to pay $90. If you pay only $50, a warrant will still go out for your arrest until the remaining $40 is paid. So I would say the rumor you heard is false.

He will only owe the remaining in back child support. With my son's dad, they will not do anything unless he is a specific amount behind (which in my state is $3,000.00 or is 3 months behind with NO payments made) But the reason the state really don't do much his because when the father fills his taxes, you will get the money, they will take that money and give it to you.
Child support sucks when the father doesn't pay that much. It is the child that suffers. But you can look at your court order and find out how much behind or how many months behind and what will happen. I know that mine states it.

If he is ordered to pay 300.00 and does not then eventually the amount will become delinquent and he will probably be taken to court by the state(if the state is in the picture). Here in NH its 1000 and then they get an order to go back to court. In Mass I believe its 2,000 but I can't be sure.

If its out of court and the amount unpaid builds up the party who is recieving childsupport can file a contemt of court hearing.

yes it is true i was court ordered 150 amonth and i was lucky when i got 60 a month some months i only got 31.00 i never got the full amount the thing you can do about it is keeping pushing the issue about your your support to the da office and still nothing may change all it'll do is keep adding to what he owes you. sorry but it's basicly true. oh and sooner are later he'll go to jail for oweing so dammn much "lol"

He will not get into trouble if he he can prove that's all he could pay, but if he can afford to pay the full amount then he will be punished. He can get by with only paying $50 a few times but if he tries it every time I would call and talk with lawyer.

yes,no matter what he pays if it is not the full court ordered amount he can the only problem is if you are going through support enforcement he has to be so far behind in arreares (payments)before they do anything. and ususally when they do -they only get an arrest warrant and leave the rest up to you. my best advice is if he is behind hire a private attorney and get your child support.

~~~most likely he will end up having to pay back childsupport payments,,,,If he cannot afford to pay $300.00 a month mabey he needs to go back to court to get re-evaluated,,,but if he Can afford but is just being a jerk and paying only $50.00 a month, then the mother of his children needs to take him back to court! ~~~

it is true that if he is attempting to pay they can't do to much cause i know i pay child support myself...but for me they take it right out of my check so i don't have to worry about that. and that is what you should have them do also...as long as he isn't working under the table you should have a problem
