I checked the Sonoma County Superior Court website and also the DMV for CA. These sites do not link to the official laws of the government.

There must be a place, in a book, where the law is written that authorizes a police officer to issue a ticket to a motorist. In this case I was a passenger who, the officer claimed, was not wearing my seat belt properly.

I am considering contesting the ticket and I would like to get the facts first.

CA vehicle code 27315(d)(1):

A person may not operate a motor vehicle on a highway unless that person and all passengers 16 years of age or over are properly restrained by a safety belt.

The seat belt laws changed awhile back. It is mandatory in each state now and even for passengers in the front and back seats. You should be able to check out laws under California Revised Statutes. You'll have to search the internet for the site, then search the site for what you want. I recently learned of a great search engine site that actually gives to charity whenever you use it. I offer you the following website to look up your citation violation. When you go to this page, put a 'check' in the 'vehicle code' box on the left hand side column. At the bottom enter the section your were cited for or just put in the key word 'seat belt' and you get some options. Look in the 27000 series for the violation that fits your cite, or look specifically for the section appearing on your copy.

You're smart to read the violation before making decisions to go to court or not. Many people who fight a ticket never read the actual violation language, and just go to court to argue the matter based on their opinion and emotion.

It is a law in every state that a passanger has 2 wear a seat belt .Good Luck

U could go to the cemetary... I'm sure someone in there would be alive today if they'd worn thier seatbelt. Pay your fine and buckle up next time. Easier to comply then try to beat the law.

Look at the state statue number on the ticket and google that.

go find an annotated revised code of Cali, RCC at any law library, and may local libraries.
