I gathered over 54 signatures from my subdivision because a church was going to be built in our neighborhood. We just didnt feel it was right because of sexual abuse in churches and the way they preach intolerance and this is not healthy for children. especially child mollesting priests.

Well We Fought the plan to build and we won. The county said that if more than 20 people in the subdivision object, then the church cant be built on the property. The church was trying to rezone property.

You may celebrate your civic "victory" if you so desire.

If you are asking whether or not the church can appeal the decision, you're in the wrong category.

If there is a basis for their appeal, sure, they can appeal.
And they might have the court issue a "Show Cause Order" which forces the town planning Board to explain the reasons why the church cannot build on their chosen site. The church can also request an Article 78 from the court which would force the Town Board to follow the law.
You should be aware that many Town Boards require that churches be built in neighborhoods these days so as to protect the income from tax revenues for high-price commercial property.

A lot of municipalities want to limit the number of churches in certain areas because of traffic flow issues, street lighting problems, signage restrictions, and related practical matters. If you suspect your Baptist friends may wish to appeal, you should talk to the city zoning and planning director and the city council, to make sure the reasons are set out clearly in council resolutions and zoning rules.

Any court decision can be appealed, except the decision of the US Supreme Court, which can theoretically be appealed to the Congress. The key to preventing a decision from being reversed on appeal is to make sure the original court's ruling was well written and clear, and the reasons are clear. If the court did not express the ruling in terms of local law and regulations, be sure those are introduced into the defense on appeal.

Though I would say that if you got 54 signatures, you have a pretty strong argument in the eyes of most courts. Religious issues aside, your neighborhood has a perfect right to ask the religious to build somewhere else. Make them a good offer for the land, and build something else there. Have the 20 families go in together and keep it as a greenway. Have a contract to prevent the land from being sold. Good luck!

no county can prevent a church from building or buying land on the basis of religious discrimination. They have as much right to be there as a school or a business. Thye church could sue the county. They may choose not to do so just so that they do not antagonize the community. But your logic is really flawed. For the most part, it is the church that has held a moral standard high preventing abuse. It is only a very few who have abused. It is not right or fait to judge all by what a few have done.

I am not sure what church your speaking about, perhaps a Catholic church, yet sexual abuse doe not happen in every church, no more then it happen in ever school, I am a survivor from child hood sexual abuse, sexual abuse can come from your Mother ,dad, brother, sister, grand dad and grand ma, your neighbor, your best friend, the police officer , fire man, any one, I have zero tolerance of any type of abuse. An all offender should be place permanently in a gage and never to be allowed out in the society ever again. I tell you one thing If God wants a church in your neighborhood, he will put a church there.

That is a rotten rationale you have - sexual abuse occurs more in homes than in Churches (for example) and I can only believe this church would have to be a Catholic Church or your motives really don't make sense (even if that is really unfair the Catholics). I don't have any problem if you don't want a Church in your neighborhood - the issue is your motives are poor.

Good on you. Churches are becoming like McDonalds. They spring up everywhere. Religions talk about love and tolernace, and yet vilify just about every group they can find. Sending impressionable kids to church to learn hatred should be classed as child abuse.

They should! That's just ridiculous to say something so dumb. Just because certain priests have been convicted of child molesting doesn't mean that church con sits of that. Obviously you don't have any knowledge of what goes on in a real church.

Right, every single church is screaming for it's followers to go out and find kids to rape, and to beat up gays, you are so full of yourself that I can smell it from here. Real Christians don't tolerate murderers, rapists, communists like you, perverts, we hold ethics and morals to be paramount. But you go ahead and pat yourself on the back and teach your child to have high self-esteem, the prisons are full of wife beaters and rapists who have high self-esteem. FOOL!
