I have been living in the U.S. for 3 years and have two children, both American citizens. I have my own business and pay my taxes. My wife and I are illegal - without green cards. Can the government send us home and keep our children here?

You are both criminals. They should send you home, and take away your children. What a nice example you have set for your children.

How do you run a business if you don't have legal papers (eg. social security numbers, immigration papers, etc)? So you have most likely committed tax fraud also.

Just because you own a business and pay taxes does not get you a free pass for breaking US Law.

What a fine example you set for your children,if as you say you are here illegally you broke the first law you encountered in the US,good start. Then if you actually pay taxes on the income you earn you must have some sort of false documents in order to be doing that,that's called forgery and document fraud,felonies in case your wondering.Personally I say they should deport you, declare you as unfit parents considering you're both felons,take away your children and put them up for adoption,and insure you never have any contact with them so that they could grow up to be law abiding citizens,but that's just my opinion.

I concur with mimi here. Yes, they will send you and your wife home. It's up to you if you take your children with you, but if you love them, I can't see why you would leave them when you are deported. Go back home and apply to return LEGALLY. Do your kids a great big favor and teach them to be legal, law abiding citizens by example.

They can deport you and let your children stay here and give you the option to take them home with you..please find a way to become legal or you will be deported...your children will have the option to come back when they are older..they are united thats citizens they will never take that from them..good luck

I don't know in your case, but I've seen it done. Somehow you need to start the process of becoming legal. Your business taxes and papers showing how successful you have been here, plus the children should help. Find an immigration lawyer. Maybe if you contact the leaders of your community they can get you to an inexpensive. We want to keep you here!

Your choice....take them with you or turn them over to someone else....

So, in order to have a business you must have stolen someone's ID...do you have any feelings for those whose lives have been disrupted by you and your wife? Do you realize the cost to those whose lives you've stolen?

The best thing is for you to collect your "stuff" and money and go back to your homeland in an organized fashion. If you are picked up, you'll go with what's on your back.

While I have sympathy for those who wish to be here....I cannot condone for one and not for another. Fair is fair and obeying the law is the only standard we can demand.

Feasibly they could still send you home, I doubt they'd split up your family though. They'll probably just deport one of you, which they do all the time. Maybe you should get a lawyer and become legal instead of using your kids as leverage.

Tough question, but I believe they can. My niece was a US Citizen, her mother was Scottish. Her mother had custody of her after my brother divorced her. The INS offered her a ticket for herself and her daughter back to Scotland if she would forgo the deportation hearing. She took the ticket, my brother then went into English courts to enforce the custody order which required that she not remove her daughter from the county in which they resided without notice, which resulted in a reversal of custody and return of my niece to the US with her father.

So, it appears the INS can deport you regardless of the status of your children, but if you are custodial, they will probably arrange for you to take them with you or allow you to get them legal guardians here who are here legally or citizens.

YES .. and if you go to the INS office the WILL deport you! You may want to hire an immigration attorney to plead your case. He can help you file the correct paperwork to apply to immigrate here legally. You are NEVER going to really live the American dream if you skirt around the law ... do it right!

Your children could stay with a relative who is a citizen, but why would you leave your children in a country that has sent their parents away. No parent would leave their kids here while they were deported.
