I know for a fact that is illegal to get paid less because of gender for equal jobs and work but how do companies still get away with it??

It's more subtle than that. Better raises and performance reviews for the guys will justify the pay differential in an audit. Promotions count too. Some of this may be due to women staying home with a sick kid more than men will, and other childcare issues.

Another issue is that a substantial number of women opt out of the work force for a few years to be stay at home moms. They have fewer years of work experience than men do when they opt back in, so lower pay.

More and more companies are billing themselves as 'equal opportunity employers' which means they offer the same benefits to all employees, regardness of sex, race, color or creed. That's a big plus and it is companies like these that are going to eventually force all companies to live up to the equity rules.
In fairness, though, in some companies the employees are not all equal. Some may be more experienced, some may be higher producers, some may be better educated and some may have been with the company longer. These are all factors that impact upon wages.
Unions have been a powerful force in ensuring gender equity in jobs, but now the major violaltors are in the so-called 'professional' jobs, such as real estate, or used car sales, where each person negotiates his or her own contract. If you agree to work for less, that's what you'll get paid. If you hold out for more, you'll get more than the person who just took what was offered.

While it is illegal to pay more because a person is male or female pay is based normally on production of work, lenght of time on the job, past job experience, education and alot more.

It is very hard to prove sex is the exact reasons.

Now if you have a busniess that just hires all men at 9 dollars a hour and all women at 8 dollars

Maybe the work load is not equal. I have had women com into my machine shop wanting a job, no experiance or whatever. You put them on the bottom job, they can't handle it and have the gall to say they should be in the front office. Then get mad when I tell them to take a hike.

Because they can! The women are so glad to have a job that they don't complain. See the men leave and the women have a couple of kids to support.
