A collection agency will not provide an unambiguous settlement agreement. can i c & d them and settle directly with origional creditor only; under the laws and rights extant in the FCRA.?

You can resolve the whole situation by calling the original creditor.

If the original creditor summarily refers you to the collection agency, then you have no more recourse to deal with the original creditor.

The original creditor will let you know if the "window of opportunity" for settlement is gone.

The FCRA allows you to send a cease and desist letter to stop the collection agency from calling or writing you (unless they need to inform you of pending legal action they are going to take).

Filing a cease & desist does not necessarily give you access rights to settle with the original creditor directly.
