do you think that someone who murders a pregnant woman should be charged for one or two counts of murder? by that belief, the murderer should only be charged for one. by the belief that life starts at the moment of conception, it should be two counts of murder. we all know the lack of separation of church/state, anyway i'm just curious to see what people believe.

Abortion is not murder and a fetus has no legal standing as a person. The legal standing issue is being altered due to thumpers improperly using their tax exempt organizations to influence legislation, but a fetus has no reason to be considered a person.

A fetus has no legal standing as a person because persons have inalienable rights that cannot possibly be extended to a fetus.

Should a pregnant woman be required to buy two seats on public transport in recognition of the claim they are two persons?

The legal quagmire that results from proclaiming a fetus to be a person is incalculable. When are fetuses (through their mothers) going to begin suing people? Maybe they should be included in the misguided tobacco lawsuits. Maybe they should be entitled to sue their parents for being mean to them.

It is a lawyer's dream come true but will be a nightmare for everyone else.

Declaring a fetus a person is an incredibly short sighted and stupid idea.

the life is in the blood! the baby's blood is different from mom's blood- thoush the baby needs mom as "life support" he or she is still a seperate being. My daughter's best friend was premature and weighed aobut 2 lbs at birth- she is now a healthy thriving, beautiful 13 year old.
Though there is a very slim chance of life outside the womb at that age it is possible. Inside or outside the womb does not make a difference- if someone murders a pregnant woman , they have put and end to TWO lives and should be charged as such!

*** for all these people saying that the baby is not a life and has no legal standing, let me ask this-
why is it that pregnant women are urged not to drink, do drugs, ride on roller coasters, etc. while pregnant? these things won't hurt her- she has probably done them all her life? It is because they will endanger the LIFE living inside of her- why do babies that are born with birth defects and sickly from addictions because their mom was on drugs or whatever while she was pregnant get removed from thier moms custody at birth- from birth to the taking the child away the mom did not have an opportunity to abuse or neglect the child- it is because when that LIFE was growing inside of her she neglected and abused him or her and the evidence is seen at the moment of birth. This is not a hard or religious issue- this is common sense and the blinders come on when it comes to the comfort and selfishness of the parent- it is easier to think of the baby as a blob so you don't feel so guilty when you terminate his or her life- by some of the logic on here , I pray that you never have children because I would hate to see when your 6 yo that has 'no legal standing' becomes an inconvenience for you- how long will it take before you start pushing for the right to terminate their lives??

I always thought that each state had a different law in regards to that, I beleive in New York the fetus must take a breath to be considered a child/baby(alive), and thus a murderer may be charged with two counts of murder.

Thats a tricky question.

I belive since the baby, while inside the mother, has it's own heart, and own heartbeat, it is alive. You can feel the baby moving inside you, that's life, sometimes others can see or feel the movement. I think life begins either at conception, or when the heart develops and starts to beat.

And, yes I definately believe that if someone murders a pregnant woman, he/she should be charged with 2 murders.

A pregnant woman has a life growing in her so yes, one should be charged for two murders but if the murderer didnt know she was pregnant if it was like a few weeks or she want showing the second murder would be manslaughter for they didnt know they were killiing two.

Well here is a tough one. I think that legally they should only be charged with 1 count of murder. But my frosted side say they should be charged as two because the mother intended to have the baby. I think that if the fetus hits the viable stage then they should be charge with 2 counts. Before viable stage. Only one count.

If the baby hasn't been formed yet - you know a fetus - then the person should only be charged for one murder. Other than that, the baby is living and forming, just not breathing and the person will definately be charged for two murders. Without a doubt.

They should be charged with TWO counts, weather the other person knew she was pregnant or not, as someone else stated. And I hate the word (fetus) , it makes the unborn child sound like a fungus or something. God knows us before we are born, so that tells me, in his eyes we are a person even if the little child is not completely formed

I think since the person ended 2 lives, then they should get charged with 2 murders, like Scott Peterson did.

In my idea, he should be charged for two murders. The reason I believe this is because, the baby is growing inside of her.
